i see it this way: remember the campaign going something like this:
"Buzzed driving is drunk driving"

buzzed is drunk... it has altered your mind, thus changed said state...

in their eyes by their terms given... just a perspective.

just ask about proof you did it... where as circumstantial and here-say don't hold up... your first bit of thinking should have been to answer zero questions to the police. Let them charge you and "seek council". anything you say can and will be used against you in a court of law. There are ZERO provisions for it to help you. Any type of an admittance gives the officers leverage to do something against you.

Did you EVER mention that, or to *any* extent your level of alcohol consumption or state of intoxication, after they read you your rights? This is a critical-thinking question (meaning forget about semantics), and one that could toss out any claim they have regarding drunk in public.

Sounds like you could get both tossed out since they have no clear evidence you were drunk, and someone else admitted to the crime.

Best thing you can do in the future is WALK AWAY from anything like this before it starts. Its fine IMO to do kiddy emo shit to restaurants and sign posts when you're a kid, but not an adult. Same for watching someone do this shit - adults either stop them, walk away, or knock their friend out if the first 2 aren't an option.

It's a class C misdemeanor, no jail time. Just a fine. Even the class B is highly unlikely for jail time. Especially considering I have zero criminal history beyond a few speeding tickets.
