So i need some legal advice I guess. Sunday night me and a buddy walked to a bar a couple blocks from my house. Drank till closing and then walked to jack in the box next door. They wouldn't serve us since we walked through the drive through, so I pissed in the drive through. That's not what got me arrested though. We the. Walked to taco bell across the highway, and tried to walk through their drive through since the building was closed. They wouldn't serve us either. So we walk down the highway a bit and get to a carwash where some kind of metal box/sign thing was bolted to a picket fence. My friend decided to go apeshit on it, busting it off the fence. He busted two boards out of the fence as well. Then he smashed it a couple times, and ripped the wires off the ground. I had nothing to do with it at all, besides being their. A cop must have seen him at some point cus they turned on the next street fast. We jogged behind a building an layed down. They pass us a couple times looking for us. Then we get up to leave. As we are walking away, a cop pulls up behind me and points his spotlight at me. I turn around and my friend is gone. I talk to the cops for a minute and they arrest me cuz I said something along the lines of being buzzed. Got charged with drunk in public and criminal mischief over $500 under $1500. I'll take the drunk in public no problem, but I'm not down with the criminal mischief. I have already talked to my friend and he feels really bad that I got arrested for something he did, so he tried to turn himself in the next day. But they said that since they already got me, they have no reason to hold him. I got out the next morning after seeing the judge and getting a PR bond of $3000. My friend said he would go with me to court and admit it was him and I was only their. I know I'm guilty by association, but I don't think I should be held liable for the whole thing. I also can't come back to work till my class C misdemeanor is reviewed by my regional directed, then the class B goes to his boss for review and approval. And I'll probably empty my time while I'm off, and then it's at the wardens discretion wether I can return to work at all. So I might even lose my job over this.

Definitely time to hire a good lawyer. Any lawyer worth his weight in cowboy hats should be able to get both charges dropped fairly quickly.

Yeah the irony isn't lost on me lol. It was wierd being on the other side for sure. As soon as the investigator came to talk to me, I lawyered up. Didn't say anything to him. They also didn't read me my Miranda rights till the investigator came (around 8 I'm guessing). So I'm waiting for a court appointed attorney now.

Yeah I know, but too broke to afford my own. Besides that, it's a pretty simple case. I could probably represent myself with just the couple law classes I have taken.

For the record, I was only buzzed. And I had been drinking all day. Wasn't shit faced or anything like that. Normally it takes back to back like 7-8 beers to get me drunk, but if I'm just drinking to drink, I can mostly go all night without getting shit faced.

Might have to check with my moms lawyer. He is pretty good. Fucked my dad real hard in the divorce, and my mom was the one who cheated on him lol.

Not sure how it works where you are, but this is how I handle court shit when it comes up.

Court Date 1: Go to court on your own/with your buddy in this case, and meet with the prosecutor. Explain the situation. If he/she won't drop the mischief charge, go in front of the judge and ask for a continuance to retain legal counsel.

Court Date 2: Show up with attorney and your buddy, both of you in suits, and hope the attorney has a decent relationship with the new prosecutor for the case.

The good news is you can likely prove resonable doubt to criminal mischief, the bad news is you have to pay a lawyer to deal with court which can be very pricey.

You might be able to work a deal with all involved, but you WILL need a decent lawyer.

Haha no.... Not here. Cops don't like us around here. Probably because there is around 1k of us in this one area, so they have to deal with us alot. Oh my friend works at the same unit I do as well, so he got lucky. I can't even go back to work till its cleared up.
