. but in the end of the day, the store clerk commited murder. the first head shot was self defence. the 5 shots to the back was murder. the worse thing the store clerk could of said was the kid was getting up. that means he was still alive after the head shot and was shot 5 times in the back. ( MURDER)

is he had 18 rounds in a magazine and 2 magazines and unloaded all 18 rounds into the kid and then reloaded and dumped 18 more rounds it would still be self defense....

but if he had a revolver and dumped 5 rounds into the guy (well say he didnt have a speed loader) and then dumped the shells and then reloaded the next 5 rounds and then dumped 5 more rounds it wouldnt be self defense... even if he did have a speedloader.. it would still be sketchy grounds...

the point isnt how many rounds he put in the kid.. its the fact that the kid was no longer a threat...

I agree with bukaroo. If he unloaded the whole clip on him fine, it's self defense. when you come back and unload on the guy it's murder. He set his mind at that point he wanted the guy dead when the threat was over. He'll get out of murder charges easy, definitely deserves manslaughter though.

P.S. If it was me that security tape would have been missing/damaged.

If it was a case in which the defender shot several times at once to terminate the threat against his life, this wouldn't even be an issue.

In this case, though, with the information given, the defender did not shoot all at once, he had ample time to assest the situation, and determine if the threat from the man with the bullet in his head was still viable. I don't honestly believe that a man with a bullet in his head, lying on the floor motionless is a threat.

To shoot a person that is not a threat to you at that time is against the law.

If you shoot somebody in self defense and kill them, is it illegal to shoot their body again? At that point you aren't "killing" them anymore.

Regardless of his intentions, there's no way to prove beyond a reasonable doubt that the kid wasn't already dead when he fired the second gun.
